Welcome to https://store.fuel-up.com/ (hereinafter referred to as the "Site"). These Terms of Service (hereinafter referred to as the "Agreement" or "Terms") govern your access to and use of the Site, as well as the purchase of any products through the Site.


1. OUR LEGAL ENTITIES AND GOVERNING LAW

Depending on your location, your purchase is made with one of two separate legal entities:

If you are located in the United States, Canada, or South or Central America, your contract of sale is with Fuel UP USA Inc. (EIN: 37-2111662), registered at 1599E 15th St., 5th Floor, Brooklyn, NY 11230, USA. These transactions are governed by the laws of the State of New York, USA.

If you are located in the European Union or elsewhere outside the Americas, your contract of sale is with Fuelup Factory Sp. z o.o. (VAT/NIP: 5842856230), registered at ul. Galaktyczna 32a, 80-299 Gdańsk, Poland. These transactions are governed by the laws of Poland.

By placing an order, you agree to the terms of the entity handling your transaction, as determined by your delivery region.


2. IMPORTANT HEALTH AND PRODUCT DISCLAIMER

The products sold on the Site are dietary supplements and are not intended as medicinal products or drugs.

  • US Market: These statements have not been evaluated by the Food and Drug Administration (FDA). This product is not intended to diagnose, treat, cure, or prevent any disease.

  • EU and International Market: These products comply with applicable food safety and labeling regulations and are not intended as a substitute for a varied and balanced diet.

  • Recommendation: Consult a qualified healthcare professional before starting any supplement program, particularly if you are pregnant, nursing, taking medication, or managing a chronic condition.


3. AGE RESTRICTIONS AND ACCOUNTS

By registering on the Site or making a purchase, you confirm that you are at least 18 years old and have full legal capacity to enter into this Agreement. You are solely responsible for keeping your account credentials and password confidential.


4. PRICES, PAYMENT, AND TAXES

  • All prices are displayed on the Site and are subject to change by the companies without prior notice.

  • For US Customers: Prices are typically displayed excluding sales tax. Applicable Sales Tax will be calculated and added at checkout based on the specific delivery address/state.

  • For EU Customers: Prices include Value Added Tax (VAT) in accordance with applicable EU tax legislation.

  • You agree to provide current, complete, and accurate purchase and payment information. We reserve the right to refuse or cancel any order at our sole discretion (e.g., in cases of suspected fraud, product unavailability, or pricing errors).


5. SHIPPING AND DELIVERY

We operate two separate warehouses (in the USA and in Europe) to ensure optimal logistics and fast delivery times.

  • Order Routing: Orders from customers in North and South America are fulfilled and shipped from the US warehouse. Orders from customers in Europe and other international regions are fulfilled and shipped from the European warehouse. We reserve the right to change the fulfillment warehouse depending on actual stock availability.

  • Delivery Times: Delivery dates provided on the Site are estimates only. We are not liable for any delays caused by customs clearance procedures, postal carriers, or force majeure events.

  • Customs Duties and Imports: If an order is shipped from a warehouse located outside your country or customs union (e.g., shipping from the US warehouse to an EU country), the Buyer acts as the importer of record and assumes full responsibility for paying all import duties, taxes, and customs fees imposed by your local authorities.


6. RETURNS AND REFUNDS POLICY

Because our products belong to the category of dietary supplements, strict health and safety regulations apply:

  • Return Period: You have the right to return a product within 14 days from the date of delivery for both US and international orders, only if the product packaging remains unopened, the protective seal is fully intact, and the product is in its original merchantable condition.

  • Opened, unsealed, or used products cannot be returned or exchanged due to hygiene and health protection reasons.

  • The cost of return shipping is borne entirely by the buyer, except in cases where the product was delivered damaged or the wrong item was shipped by mistake. All return requests must be initiated by contacting return@fuel-up.com.


7. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Fuel UP USA Inc. and Fuelup Factory Sp. z o.o. shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use of this Site or the misuse of products purchased on the Site. Our aggregate liability for any claim shall not exceed the actual amount paid by you for the specific product that gave rise to the dispute.


8. INTELLECTUAL PROPERTY

All content featured on the Site (including texts, designs, graphics, trademarks, logos, and product images) is the exclusive intellectual property of Fuel UP USA Inc. and Fuelup Factory Sp. z o.o. and is protected by international copyright and trademark laws. Any unauthorized copying, duplication, or commercial use of these materials is strictly prohibited without prior written permission from the applicable entity.


9. DISPUTE RESOLUTION AND JURISDICTION

  • Any disputes, controversies, or claims arising out of or relating to transactions handled by the American entity, Fuel UP USA Inc., shall be subject to the exclusive jurisdiction of the courts of the State of New York, USA.

  • Any disputes, controversies, or claims arising out of or relating to transactions handled by the European entity, Fuelup Factory Sp. z o.o., shall be subject to the exclusive jurisdiction of the courts of Gdańsk, Poland.
